Special Education and School Law Attorney Goldberg represents parents of children who are faced with the task of dealing with school districts over issues such as Chapter 766, Individualized Education Programs (IEPs), student dress codes, sexual harassment and other matters. He is a member of the Council of Parent Attorneys and Advocates (COPAA). A parent of a child with a disability must confront new challenges on an almost daily basis. Few of these challenges are as confusing and intimidating as securing the appropriate services the child is entitled to receive from the school district. Issues that a parent of a disabled child may face are as diverse as private school placement to school discipline. The laws regarding services for such children are fast changing and complex. Both the federal and state laws in this area contain procedural requirements that can lead to grave consequences if not handled correctly. In addition, unlike most areas of law, parents of a disabled child may recover attorneys fees from the school district if the parents are determined to be the "prevailing party" in the dispute. Many special education cases are resolved by mediation. Cases that cannot be settled by the parties are heard by the Bureau of Special Education Appeals. Recently, Attorney Goldberg was successful in obtaining the immediate admission to a public school of a special needs student who had changed school districts and was denied attendance in the public school in his new district. |
